APPLICATION

CONDITIONS

1. Purpose

These Application Conditions define the rules governing the submission, review, acceptance, maintenance and withdrawal of applications submitted to Pangearts.

 

They supplement the General Terms of Use (GTU), the Legal Notice, the Privacy Policy, the Cookie Policy, as well as any specific document applicable to particular services, programmes, competitions, festivals, events or other specific projects.

 

Any application submitted to Pangearts constitutes full and unconditional acceptance of these Application Conditions.

 

2. Scope

These Application Conditions apply to any natural or legal person wishing to obtain a listing, a profile publication or participation in a listing programme offered by Pangearts.

 

They apply throughout the entire application process as well as for the entire duration of any listing on the platform.

 

These Application Conditions apply regardless of the applicant's country of residence, establishment or activity.

 

3. Eligibility requirements

Applications are reserved for:

  • natural persons of legal age with the legal capacity required to enter into binding commitments;

  • legal entities duly incorporated in accordance with the legislation applicable to them.

 

Any person submitting an application on behalf of a company, association, institution, gallery, school or any other organisation declares that they have the necessary authority to represent that organisation.

 

Applications submitted by minors are not accepted unless expressly authorised in advance by Pangearts within the framework of specific programmes or projects.

 

The applicant warrants that all information provided in connection with the application is accurate, complete and truthful.

 

4. Eligible application categories

Pangearts may, in particular, accept applications from:

  • artists;

  • galleries;

  • artists' agents;

  • managers;

  • art education institutions;

  • schools;

  • academies;

  • universities;

  • museums;

  • cultural centres;

  • cultural associations;

  • foundations;

  • artistic groups;

  • artists' collectives;

  • and, more generally, any natural or legal person whose activity is related to the artistic, cultural, creative or heritage sectors.

 

This list is provided for information purposes only and is not exhaustive.

 

However, applications may only be submitted for listing categories that are actually open and available at the time of application.

 

Pangearts remains free to create, modify, merge, suspend or remove any listing category and to determine which categories are open for applications at any given time.

 

Carrying out an activity in the artistic, cultural, creative or heritage fields does not create any right to the creation of a specific listing category or to the acceptance of an application.

 

5. Submission of applications

Applications may be submitted using the procedures made available by Pangearts.

 

An application may, in particular, be submitted:

  • by means of an online form;

  • by email;

  • by any other method of submission expressly authorised by Pangearts.

 

The applicant bears sole responsibility for all information, documents, links, contact details, works, photographs, visual materials or other content submitted as part of the application.

 

The submission of an application does not guarantee either its acceptance or its listing on the platform.

6. Information and supporting documents

The applicant undertakes to provide accurate, truthful, complete and up-to-date information.

 

Pangearts may request any additional information or supporting document it considers necessary for the examination of the application.

 

The applicant remains solely responsible for the information, content and documents submitted.

 

The applicant warrants that they hold all rights, authorisations and licences required in relation to the content, works, images, photographs, texts, logos, trademarks or any other material submitted to Pangearts.

 

The submission of inaccurate, misleading, fraudulent or incomplete information or documents may result in the rejection of the application or the subsequent removal of the listing.

 

7. Review of applications

Applications are reviewed by Pangearts in accordance with the criteria it considers relevant in light of its objectives, editorial policy, operating principles and overall direction.

 

Pangearts remains free to determine the procedures, criteria, priorities and methods applicable to the review of applications.

 

The applicant acknowledges that submitting an application does not create any right to acceptance, listing or publication of a profile.

 

Pangearts is under no obligation to review an application within any specific timeframe.

 

Pangearts may request additional information, suspend the examination of an application or close an application whenever it considers this necessary.

 

As part of the application review process, Pangearts may carry out any verification it considers useful regarding the information, statements, documents, references, contact details, activities or content provided by the applicant.

 

Such verifications may include consulting websites, social media platforms, public registers, publications or any other lawfully accessible sources of information.

 

The applicant undertakes to cooperate in good faith with any request for additional information made by Pangearts during the examination of the application.

 

8. Pangearts' decision

Following the review of an application, Pangearts may, in particular:

  • accept the application;

  • reject the application;

  • request additional information or supporting documents;

  • suspend the examination of the application;

  • postpone its decision;

  • close the application without further action.

 

Pangearts remains free to make its decisions in accordance with the applicable laws.

 

The applicant acknowledges that no application gives rise to an automatic right to acceptance or listing.

 

Pangearts is under no obligation to provide detailed reasons for its decisions concerning applications.

 

Unless expressly agreed otherwise, no processing or response time is guaranteed.

 

9. Listing on the platform

Acceptance of an application may result in the publication of a profile on the platform.

 

Listed profiles may include, in particular:

  • the member's name or business name;

  • presentation information;

  • representative works, achievements or content;

  • professional contact details;

  • links to websites;

  • links to social media accounts;

  • any other information submitted or validated as part of the listing.

 

The listed member acknowledges that the information published on their profile is intended to be publicly accessible.

 

Published profiles, content and information may be viewed by visitors located in different countries.

 

They may also be indexed, referenced, archived or reproduced by search engines, indexing services, content aggregators, archiving services or other third parties independent of Pangearts.

 

Pangearts cannot prevent or control all such activities carried out by third parties.

 

Acceptance of an application does not confer any vested right to the permanent maintenance of the listing or the profile on the platform.

 

10. Obligations of listed members

Throughout the duration of their listing, listed members undertake to:

  • comply with these Application Conditions;

  • comply with the General Terms of Use, the Legal Notice, the Privacy Policy and the Cookie Policy;

  • keep their information accurate and up to date whenever possible;

  • cooperate with Pangearts in good faith whenever additional information is requested;

  • respect the rights of third parties;

  • comply with all applicable laws and regulations.

 

Listed members also undertake to maintain at least three items of content representative of their activity on their profile whenever this requirement applies to their listing category.

 

Pangearts may adapt this requirement for certain categories of members where the nature of their activity so justifies.

11. Communication and promotion of Pangearts

Listed members contribute to the collaborative and international nature of the platform.

 

Where Pangearts provides a certificate, confirmation or any other document validating an application, the listed member undertakes to publicly announce their acceptance or listing on the platform within a maximum period of twenty-one (21) days from its receipt.

 

Where the listed member uses one or more social media platforms to communicate publicly about their activity, works, projects, services or any other activity related to their listing on Pangearts, they undertake to publish at least four (4) separate public communications per calendar year mentioning Pangearts, their Pangearts profile or their activities on the platform.

 

Where the same communication is published simultaneously on several social media platforms, it shall be considered as a single communication for the purposes of these Application Conditions.

 

The listed member also undertakes to remain subscribed to the official Pangearts accounts on the relevant social media platforms throughout the entire duration of their listing on the platform.

 

The voluntary cancellation of such subscriptions without a legitimate reason shall constitute a breach of these Application Conditions.

 

Where the listed member has a website, they undertake to display the Pangearts logo together with an active link to the Pangearts homepage within a maximum period of twenty-one (21) days from the date of their listing.

 

Such display shall be maintained throughout the entire duration of the member's listing on the platform.

 

Where the listed member distributes a newsletter, information bulletin or any comparable communication system as part of their activity, they undertake to mention their Pangearts profile or the Pangearts platform at least once per calendar year in one of their communications.

 

Pangearts may request the listed member to provide any reasonable evidence demonstrating compliance with the obligations set out in this Article.

 

12. Content and intellectual property

The listed member remains solely responsible for all content, works, photographs, texts, logos, trademarks, documents or any other material submitted to Pangearts.

The listed member warrants that they hold all rights, authorisations and licences required for the content submitted or published.

 

The listed member retains full ownership of all intellectual property rights relating to their content.

 

In order to ensure the proper operation of the platform and the promotion of its activities, the listed member grants Pangearts a non-exclusive, royalty-free, worldwide licence limited to the period during which the content is published on the platform.

 

This licence notably authorises Pangearts to reproduce, display, distribute, communicate, technically adapt, translate, format or otherwise use the relevant content in connection with:

  • the website;

  • the official social media accounts;

  • publications, magazines, journals, newsletters or any other editorial media developed or operated by Pangearts;

  • newsletters;

  • calls for applications;

  • presentation documents;

  • projects developed by Pangearts.

 

The listed member retains full ownership of all rights relating to their content.

 

13. Suspension or removal of a listing

Pangearts may suspend or remove a listing at any time where it considers such action necessary for the proper operation of the platform or for the protection of its legitimate interests.

Suspension or removal may occur in particular:

  • in the event of non-compliance with these Application Conditions;

  • in the event of non-compliance with the General Terms of Use;

  • in the event of inaccurate or misleading information;

  • in the event of infringement of the rights of a third party;

  • in the event of activities contrary to the values or editorial policy of Pangearts;

  • in the event of a breach of applicable laws;

  • in the event of repeated failure to comply with the obligations of the listed member.

 

Pangearts may also temporarily suspend a listing where additional verification appears necessary.

 

A listing shall never constitute an acquired right.

 

Where the obligations set out in Article 11 are not complied with, and following formal notice that has remained without effect within the time limit specified by Pangearts, Pangearts may remove the listing of the member concerned.

 

Where a listing has been granted free of charge in consideration of the collaborative commitments set out in these Application Conditions, repeated or intentional failure to comply with those commitments may also result in the payment of a fixed indemnity of two hundred euros (€200), intended to compensate Pangearts for the costs incurred in relation to listing, administration, promotion and processing.

 

This indemnity is independent of any decision to suspend or remove the listing or to refuse any future application.

 

In the event of a serious, repeated or intentional breach of the obligations set out in these Application Conditions, Pangearts may refuse any new application submitted by the member concerned for a maximum period of five (5) years.

 

The measures provided for in this Article may be applied cumulatively where justified by the circumstances.

 

Pangearts also reserves the right to initiate any proceedings, claim or legal action it considers appropriate in order to protect its rights, obtain compensation for any damage suffered or put an end to any conduct contrary to these Application Conditions, the General Terms of Use, the Participation Conditions or the applicable laws.

 

The measures provided for in this Article shall apply without prejudice to any other rights or remedies available to Pangearts under these Application Conditions, the General Terms of Use, the Participation Conditions or the applicable legislation.

14. No guarantee of visibility or selection

Pangearts operates as a platform for visibility, listing and promotion.

 

However, Pangearts does not guarantee, in particular:

  • any minimum level of visibility;

  • any minimum number of views;

  • any particular promotion;

  • any publication;

  • any selection;

  • any exhibition;

  • any collaboration;

  • any partnership;

  • any professional opportunity;

  • any commercial or artistic result.

 

Listing on the platform does not automatically entitle a member to participate in a competition, festival, exhibition, publication, call for projects, ambassador programme or any other initiative organised or supported by Pangearts.

 

Each activity may be subject to separate specific conditions.

 

Pangearts remains free to determine the selection criteria applicable to each of its initiatives.

 

15. Neutrality and editorial independence

Pangearts is an independent artistic platform.

 

The platform is non-political and non-partisan.

 

Pangearts retains complete freedom in the organisation of its categories, listings, publications, selections, projects, partnerships and activities.

 

Pangearts remains free to accept, refuse, suspend or remove any application or listing in accordance with these Application Conditions.

 

Acceptance of an application does not constitute a recommendation, certification or endorsement of the quality, artistic value, professionalism, reputation or competence of the listed member.

 

Acceptance of an application does not create any obligation on the part of Pangearts to promote, publish, highlight or select the listed member.

 

16. Limitation of liability

Applicants and listed members remain solely responsible for the information, content, works, documents, contact details, statements and other materials submitted to Pangearts.

 

Pangearts does not guarantee the accuracy, completeness or continuous updating of the information published on the platform.

 

Pangearts does not guarantee any particular result arising from an application, a listing or the use of the platform.

 

In particular, Pangearts shall not be held liable for:

  • information provided by applicants or listed members;

  • errors or omissions contained in published content;

  • decisions taken on the basis of the information available on the platform;

  • relationships established between users;

  • negotiations, collaborations, services, sales or agreements concluded between users;

  • the absence of visibility, collaboration, publication or professional opportunities.

 

Applicants and listed members remain solely responsible for their relationships with other users and with third parties.

 

17. Applicable law

These Application Conditions shall be governed by Belgian law.

 

Any dispute relating to their interpretation, validity, performance or application shall be submitted to the competent courts in accordance with the rules of Belgian law, unless otherwise required by mandatory legal provisions.

 

18. Severability

If any provision of these Application Conditions is declared null, invalid or unenforceable by a legal provision or by a final court decision, the remaining provisions shall remain in full force and effect.

 

The provision concerned shall be interpreted or replaced, to the fullest extent possible, so as to preserve the original intention pursued.

 

19. Amendments to the Application Conditions

Pangearts reserves the right to amend these Application Conditions at any time, in particular in order to take account of:

  • developments of the platform;

  • changes to the listing categories;

  • developments of the services offered;

  • changes to the obligations applicable to listed members;

  • changes in legal or regulatory requirements;

  • operational needs relating to the management of the platform.

 

The applicable version shall be the version published on the platform on the date of consultation.

 

Applicants and listed members are invited to consult these Application Conditions regularly.

 

20. Governing language

These Application Conditions may be translated into or made available in several languages in order to facilitate consultation by international users.

 

Such translations are provided for information purposes only.

 

In the event of any discrepancy, inconsistency, difference of interpretation or translation error between the French version and any other language version, the French version shall prevail and alone be legally binding.

 

The rights and obligations of applicants, listed members and Pangearts shall be interpreted in accordance with the French version.
