GUIDELINES

1. Purpose

 

1.1 Purpose of these Guidelines

 

These Graphic Guidelines establish the rules governing the use of the Pangearts name, logo and visual identity.

 

Their purpose is to ensure a consistent, respectful and appropriate use that reflects the image, values and legitimate interests of Pangearts.

 

These Guidelines apply to any natural or legal person who uses, reproduces, distributes or displays all or part of the visual elements of Pangearts.

 

1.2 Scope

These Guidelines apply in particular to listed members, partners, service providers, media organisations, institutions, collaborators and any other person authorised to use the Pangearts name, logo or visual identity.

 

The use of the Pangearts name, logo or any element of its visual identity constitutes acceptance of and compliance with these Guidelines.

 

The provisions of these Guidelines apply without prejudice to any other documents, terms or specific authorisations published or granted by Pangearts.

 

2. Definitions

For the purposes of these Graphic Guidelines, the following terms shall have the meanings set out below:

 

2.1 Pangearts

The term "Pangearts" refers to the international collaborative arts platform operated under the name Pangearts, together with its visual identity, services, publications and related activities.

 

2.2 Logo

The term "Logo" refers to all official versions of the Pangearts logo published or approved by Pangearts.

 

2.3 Visual Identity

The expression "Visual Identity" refers to all elements that enable the visual identification of Pangearts, including its name, logo, official colours, graphic elements, authorised visual variations and any other graphic element used to represent Pangearts.

 

2.4 Authorised User

The expression "Authorised User" refers to any natural or legal person who has the right to use the Pangearts name, logo or visual identity in accordance with these Guidelines or with a specific authorisation granted by Pangearts.

 

3. Visual Identity

 

3.1 General Principles

The visual identity of Pangearts is an essential element of its public recognition and identification.

 

It contributes to the visibility, consistency and reputation of Pangearts, as well as to the identification of its activities, publications, programmes and services.

 

3.2 Components

The visual identity of Pangearts includes, in particular, the name "Pangearts", the official logo, its authorised versions, its official colours and the graphic elements that form its visual identity.

 

This list is not exhaustive and may be supplemented by any other visual element officially adopted by Pangearts.

 

3.3 Respect for the Visual Identity

Any use of the visual identity of Pangearts must preserve its integrity, consistency, legibility and public recognisability.

 

No use may alter, distort or otherwise damage the visual identity of Pangearts.

 

4. The Pangearts Name

 

4.1 Protection of the Name

The name "Pangearts" is a fundamental distinctive element of the platform's identity.

 

Its use must comply with these Graphic Guidelines and with the applicable intellectual property rights.

4.2 Use of the Name

The name "Pangearts" may not be used in any manner likely to create confusion regarding the identity, activities, partnerships, services or positions of Pangearts.

 

Any use of the name must remain fair, accurate and consistent with the image of Pangearts.

 

4.3 Reproduction of the Name

Unless prior written authorisation has been granted by Pangearts, it is prohibited to use the name "Pangearts" as part of a business name, trademark, logo, domain name, social media account name or any other distinctive sign likely to create confusion with Pangearts.

 

5. Official Pangearts Logos

 

5.1 Official Colour Version

The official colour version of the Pangearts logo is the primary version of the Pangearts visual identity.

 

This version uses the RGB colour 100 / 33 / 152 and should be used whenever technical and design conditions permit.

 

5.2 Official Monochrome Version

The official monochrome version of the logo uses the RGB colour 81 / 81 / 81.

 

This version may be used whenever technical, editorial or design constraints prevent the use of the official colour version.

 

5.3 Official Reversed Version

The official reversed version of the logo uses the RGB colour 232 / 230 / 230.

 

This version is primarily intended for dark backgrounds or media requiring a light-coloured version of the logo.

 

5.4 Recognised Official Versions

Only logo versions officially published, provided or approved by Pangearts may be used.

 

Any adaptation, recreation, modification or unauthorised variation of the logo is prohibited unless prior written authorisation has been granted by Pangearts.

6. Official Colours

 

6.1 Reference Colours

The official colours currently recognised for the Pangearts logo are:

  • RGB 100 / 33 / 152 for the colour version;

  • RGB 81 / 81 / 81 for the monochrome version;

  • RGB 232 / 230 / 230 for the reversed version.

 

6.2 Compliance with the Official Colours

Users are encouraged to use the official files provided by Pangearts in order to ensure colour accuracy and preserve the integrity of its visual identity.

 

Any intentional modification of the official logo colours is prohibited unless prior written authorisation has been granted by Pangearts.

 

7. Respect for Proportions

 

7.1 General Principle

The Pangearts logo must always be reproduced in accordance with its original proportions.

 

Stretching, compressing, distorting or altering the proportions between any elements of the logo is prohibited.

 

7.2 Faithful Reproduction

The logo must be used exactly as provided or approved by Pangearts.

 

Any reproduction likely to alter the visual balance of the logo is prohibited.

 

8. Clear Space and Legibility

 

8.1 Legibility

The Pangearts logo must always be displayed under conditions that ensure its immediate and clear recognition.

 

Its size must allow all of its elements to remain fully legible.

 

8.2 Clear Space

A sufficient clear space must always be maintained around the logo to prevent any confusion with other text, logos, illustrations or graphic elements.

 

No element may be positioned in a way that compromises the visibility or readability of the logo.

 

8.3 Reproduction Quality

The logo must always be reproduced in a quality that preserves its legibility, appearance and recognisability.

 

Degraded, altered, incomplete or obviously poor-quality reproductions are not permitted where they may impair the readability, recognition or image of Pangearts.

 

9. Logo Typography

 

9.1 Official Typography

The word "Pangearts" incorporated into the official logo is an essential and inseparable element of the Pangearts visual identity.

 

The typeface used in the official logo is Futura Light.

 

9.2 Protection of the Typography

The font, size, proportions, letter spacing, alignment, layout and positioning of the text within the logo may not be modified.

 

In particular, it is prohibited to recreate the logo using another typeface or to reproduce the text forming the logo in a layout different from the one approved by Pangearts.

 

9.3 No General Typography Requirement

These Graphic Guidelines do not impose any specific typeface on members, partners, media organisations or other users for their own communication materials.

 

The protection of the Futura Light typeface applies exclusively to the text incorporated into the official Pangearts logo.

 

10. Authorised Media

 

10.1 Digital Media

Subject to compliance with these Graphic Guidelines, the Pangearts logo may be used on websites, digital platforms, social media, professional profiles, newsletters, digital presentations and other authorised electronic communication media.

 

10.2 Printed Media

The logo may also be used on printed documents, brochures, catalogues, posters, presentation folders, publications and other authorised printed materials.

 

10.3 Compliance with these Graphic Guidelines

Any use of the logo must remain consistent with these Graphic Guidelines and must not damage the image, reputation or legitimate interests of Pangearts.

11. Use by Listed Members

 

11.1 Principle

Listed members of Pangearts may use the Pangearts name and logo in connection with their listing on the platform.

 

Such use must comply with these Graphic Guidelines, the Application Conditions, the General Terms of Use and all other applicable documents published by Pangearts.

 

11.2 Communication Regarding the Listing

Listed members may use the Pangearts name and logo to present their listing, profile or participation in activities offered by Pangearts.

 

Such use must be accurate, fair and must not mislead the public.

 

11.3 Continuation of the Right of Use

The right of use granted under this Article is conditional upon the member maintaining their listing and continuing to comply with all applicable Pangearts documents.

 

12. Use by Partners

 

12.1 Use within the Partnership

Pangearts partners may use the Pangearts name and logo when communicating about their partnership with Pangearts.

 

Such use shall be limited to the scope of the relevant partnership.

 

12.2 Respect for the Pangearts Image

Partners undertake to use the Pangearts name and logo in a manner that is consistent with the image, legitimate interests and reputation of Pangearts.

 

12.3 End of the Partnership

Unless otherwise agreed in writing, any use of the Pangearts name or logo must cease no later than twenty-one (21) days after the end of the relevant partnership.

 

13. Use by the Media

 

13.1 Presentation of Pangearts

Media organisations may use the Pangearts name and logo in articles, reports, publications, interviews, presentations or any other content intended to present or refer to Pangearts.

 

13.2 Respect for the Visual Identity

Media organisations undertake to preserve the integrity of the Pangearts logo and visual identity in accordance with these Graphic Guidelines.

 

14. Uses Requiring Prior Authorisation

 

14.1 Principle

Any use of the Pangearts name, logo or visual identity that is not expressly permitted under these Graphic Guidelines requires the prior written authorisation of Pangearts.

 

14.2 Freedom of Decision

Pangearts remains free to approve, refuse, restrict or make subject to conditions any request for authorisation without being required to provide specific reasons.

 

14.3 Scope of the Authorisation

Any authorisation granted by Pangearts is strictly limited to the conditions expressly specified when it is granted.

 

Unless otherwise stated in writing, no authorisation shall be interpreted as being general, permanent, exclusive or transferable.

 

15. Prohibited Uses

 

15.1 General Prohibitions

Unless prior written authorisation has been granted by Pangearts, it is prohibited in particular to:

  • modify the official logo colours;

  • modify the proportions of the logo;

  • distort the logo;

  • rotate the logo;

  • remove all or part of the logo;

  • modify the typography of the logo;

  • recreate the logo;

  • add visual effects, filters or graphic elements to the logo;

  • incorporate the logo into another logo or another visual identity;

  • use any unofficial or unauthorised version of the logo.

 

15.2 Damage to the Pangearts Image

It is prohibited to use the Pangearts name, logo or visual identity in any context that may damage its image, reputation or legitimate interests.

 

15.3 Unlawful or Misleading Uses

It is prohibited to use the Pangearts name, logo or visual identity in any context that is unlawful, contrary to public policy or accepted standards of morality, or likely to mislead the public.

 

15.4 Neutrality of Pangearts

Pangearts is an independent, non-political and non-partisan platform.

 

Unless prior written authorisation has been granted by Pangearts, the Pangearts name, logo or visual identity may not be used to support, promote or associate Pangearts with any political party, election campaign, political ideology, government, political organisation or any comparable activity.

16. Prevention of Confusion

 

16.1 No Implied Affiliation

The use of the Pangearts name, logo or visual identity must not create the impression that a partnership, endorsement, approval, certification, recommendation or affiliation exists where no such relationship actually exists.

 

16.2 Fair Presentation

Any reference to Pangearts must be presented in a clear, accurate and fair manner in order to avoid any risk of confusion among the public.

 

17. Use on the Internet and Social Media

 

17.1 Official Website Address

Where a link to Pangearts is included on a website, the official address to be used is https://pangearts.com, unless otherwise expressly provided in a document published by Pangearts.

 

Where reference is made to Pangearts on a social media platform or any other digital medium that does not require linking to the Pangearts homepage, a link to the relevant official Pangearts profile may be used where permitted or authorised under the applicable Pangearts documents.

 

17.2 Presentation of the Logo

Users of the logo shall ensure that it is displayed on websites, social media platforms and other digital media in a manner that preserves its legibility, accuracy and consistency with the Pangearts visual identity.

 

17.3 Correction of Non-Compliant Uses

Listed members, partners and other authorised users undertake to correct or remove any use that no longer complies with these Graphic Guidelines within a maximum period of twenty-one (21) days following notification by Pangearts.

 

18. Evolution of the Visual Identity

 

18.1 Evolution of the Visual Identity

Pangearts reserves the right to modify, supplement, replace or withdraw, at any time, all or part of the elements forming its visual identity.

 

18.2 New Versions

Pangearts may, in particular, introduce new versions of its logo, new graphic variations, new colours or any other visual elements intended to represent its activities.

 

18.3 Consequences

Where a version of the logo or another visual element is no longer recognised as official, Pangearts may require its replacement or removal within a maximum period of twenty-one (21) days following notification.

 

19. Intellectual Property

 

19.1 Protection of the Name and Logo

The name "Pangearts", its logo, its official variations and all elements forming its visual identity are protected under the applicable intellectual property laws.

 

These Graphic Guidelines do not grant any ownership rights, joint ownership, exclusive licence, perpetual licence, assignment, transfer or exploitation rights in relation to the Pangearts name, logo or visual identity.

 

Any use shall remain strictly limited to the authorisations expressly provided for in these Graphic Guidelines or granted in writing by Pangearts.

19.2 No Permanent Licence

Any authorisation granted by Pangearts is revocable, personal, non-exclusive, non-transferable and limited to the conditions expressly specified by Pangearts.

 

Unless otherwise expressly agreed in writing, no authorisation shall be interpreted as granting a permanent licence, an acquired right or any transfer of rights relating to the Pangearts name, logo or visual identity.

 

20. Compliance Monitoring

 

20.1 Verification

Pangearts may verify at any time whether the use of its name, logo or visual identity complies with these Graphic Guidelines.

 

20.2 Cooperation

Any person benefiting from an authorisation to use the Pangearts name, logo or visual identity undertakes to cooperate in good faith with any reasonable request for information or verification concerning such use.

21. Request for Compliance

 

21.1 Non-Compliant Use

Where any use is likely to breach these Graphic Guidelines, Pangearts may require that such use be corrected, modified or discontinued.

 

21.2 Time Limit for Compliance

Unless Pangearts expressly specifies a different period, the person concerned shall have a maximum of twenty-one (21) days from the date of notification to implement the requested corrective measures.

 

22. Withdrawal of Authorisation

 

22.1 Withdrawal

Pangearts may withdraw any authorisation granted for the use of its name, logo or visual identity at any time if it considers that such use is contrary to these Graphic Guidelines or prejudicial to its legitimate interests, image or reputation.

 

22.2 Consequences of Withdrawal

Upon withdrawal of an authorisation, the authorised use must cease within a maximum period of twenty-one (21) days following receipt of the notification from Pangearts, unless Pangearts expressly grants a different period.

 

23. Limitation of Liability

 

23.1 No Guarantee

Pangearts does not guarantee that authorisation to use its name, logo or visual identity will result in any particular benefit, visibility or outcome.

 

23.2 Responsibility of Users

Any person using the Pangearts name, logo or visual identity remains solely responsible for complying with all laws, regulations, third-party rights and obligations applicable to their own activities.

 

23.3 Third-Party Uses

Pangearts shall not be held liable for any consequences arising from any non-compliant use of its name, logo or visual identity by third parties.

 

24. Amendment of the Guidelines

 

24.1 Right to Amend

Pangearts reserves the right to amend these Graphic Guidelines at any time, particularly in order to reflect changes to its visual identity, activities, organisational needs or applicable legal and regulatory requirements.

 

24.2 Applicable Version

The version published by Pangearts at the time of the relevant use shall be the applicable version.

 

25. Governing Law

 

25.1 Applicable Law

These Graphic Guidelines shall be governed by the laws of Belgium.

 

25.2 Competent Courts

Subject to any mandatory legal provisions, any dispute relating to the interpretation, validity or application of these Graphic Guidelines shall fall within the jurisdiction of the competent Belgian courts.

 

26. Severability

 

26.1 Continued Validity

If any provision of these Graphic Guidelines is declared wholly or partially invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

 

26.2 Interpretation

The provision concerned shall, to the fullest extent permitted by law, be interpreted or replaced in a manner that best preserves its original purpose.

 

27. Reference Language

 

27.1 Translations

These Graphic Guidelines may be translated into several languages.

 

27.2 Prevailing Version

In the event of any discrepancy, inconsistency or difference of interpretation between a translated version and the French version, the French version shall prevail.
